O2 Enterprises Pty Ltd (ACN 123 132 730), trading as Segway WA, and Segway Tourism Pty Ltd (ACN 161 284 322), trading as Segway Tours WA (“Segway”)

Segway Tours WA reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times for tours, activities and Gift Vouchers without notice. However, reasonable efforts will be made to maintain the advertised product.

SEGWAY TOUR BOOKING ARRIVAL / CHECK-IN

Arrival and check-in are required 15 minutes prior to the agreed tour commencement time. If a participant does not arrive and check in by the required time, Segway Tours WA may, at its discretion, refuse participation without refund.

CANCELLATION POLICY

Guided tour bookings

Cancellations received more than 14 days prior to the tour date will receive a full refund.

Cancellations received between 6 and 14 days prior to the tour date will incur a cancellation fee equal to 50% of the full tour cost.

Cancellations received within 5 days of the tour date will incur a cancellation fee equal to 100% of the tour cost.

Failure to arrive for a scheduled Guided Tour will incur a cancellation fee equal to 100% of the tour cost.

No refund will be given for any part of a Guided Tour after a participant has commenced the training section. A refund may be granted where the instructor determines during training that the participant is unable to safely ride a Segway Personal Transporter (PT).

POOR WEATHER CONDITIONS

Inclement weather will not normally result in cancellation of a tour. Participants are therefore encouraged to wear weather-appropriate clothing and suitable footwear.

Segway Tours WA may, at its absolute discretion, cancel a Guided Tour where it considers this necessary for safety or other operational reasons.

If Segway Tours WA cancels a tour, participants will be offered an alternative date or, where applicable, a refund. Where a booking was purchased through a third-party reseller, any refund or alternative arrangement may be subject to the terms and procedures of that reseller.

Segway Tours WA will not be responsible for travel expenses or other out-of-pocket expenses arising from the cancellation of a tour.

Gift Vouchers are not refundable.

RIDER REQUIREMENTS

Participants should generally weigh between 45 kg and 118 kg, in accordance with the manufacturer’s recommended operating guidelines for the Segway PT. In some circumstances, Segway Tours WA may be able to accommodate a participant outside this range, subject to an individual assessment by our trained staff. Any such participation is at the discretion of Segway Tours WA and will depend on whether the participant can safely and confidently operate the Segway PT. If you are outside the recommended weight range, please contact us before booking to discuss your circumstances.
The minimum participant age for a Segway PT Guided Tour is 12 years. Participants must also be able to safely meet the physical and operational requirements outlined in these Rider Requirements. It is the purchaser’s responsibility to ensure that participants meet these requirements or to contact Segway Tours WA before booking if they are unsure.

Riders must wear a helmet. Helmets will be provided.

Riders should wear suitable closed-toe footwear, such as trainers. Thongs and similar footwear are not considered suitable for riding a Segway PT.

Riders must not carry bags, backpacks or other items that may interfere with the safe operation of the Segway PT. Bags and backpacks should be left in the designated storage area where available. Small personal items may only be carried where they can be securely stored and do not interfere with safe operation of the Segway.

Riders must:

• be able to stand for the duration of the Guided Tour;
• be able to stand and walk unassisted;
• be able to step onto and off the base of the Segway PT unassisted following training. The step is approximately 20 cm (8 inches) high;
• be able to lean from side to side and forwards and backwards while standing upright on the Segway PT;
• not be under the influence of alcohol or drugs;
• follow the instructions of their Tour Leader, Trainer or other supervisor at all times; and
• have adequate vision to safely operate a Segway PT and wear prescribed glasses or other corrective eyewear where required.

Riders must inform their Tour Leader or Trainer before participating of any vision impairment that may affect their ability to safely operate a Segway PT.

Pregnant women and people with back injuries or other serious health conditions should not participate in a Segway Guided Tour.

Failure to comply with safety instructions may result in the participant’s tour being terminated.

RIDE AGREEMENT

All participants are required to sign a Tour Participation and Disclaimer Form. This includes acknowledgement that the participant has read and understood their obligations and participates at their own risk.

Participants under the age of 18 must be accompanied by a parent or guardian, and the parent or guardian must sign the required forms.

ENTRY FEES

Unless expressly stated otherwise, the price of a Segway Tour does not include travel to or from the tour location or any separate admission or entry fees charged by a venue or location.

PERSONAL ITEMS

Segway Tours WA accepts no responsibility for loss of or damage to personal items stored at a tour location or carried by a participant during a Segway Tour, subject to any rights or remedies that cannot be excluded under applicable law.

RIGHT OF REFUSAL

Segway Tours WA reserves the right to refuse or terminate a participant’s involvement in a Segway Tour before commencement, during training or during the tour if the participant does not meet the Rider Requirements or fails to follow safety instructions or maintain acceptable behaviour.

Where participation is refused or terminated due to a participant’s failure to meet these requirements or follow instructions, no refund or alternative tour date will be provided.

GIFT VOUCHERS

Segway Tours WA Gift Vouchers entitle the holder to purchase eligible tours up to the value stated on the Gift Voucher, subject to the conditions applicable to the particular voucher.

Gift Vouchers may be redeemed through Segway Tours WA and online at www.segwaytourswa.com.au.

Gift Vouchers must not be on-sold by third-party companies or marketplaces such as eBay, Gumtree or similar services.

The value shown on a Gift Voucher includes GST where applicable.

Gift Vouchers cannot be redeemed for cash. No cash, credit or change will be provided for any unused portion of a Gift Voucher.

Gift Vouchers are valid for 3 years from the date of purchase and must be redeemed within this period.

An extension may be granted at the discretion of Segway Tours WA where requested prior to the Gift Voucher expiry date.

All tours are subject to availability at the time of booking.

If the price of the selected tour exceeds the available value of the Gift Voucher, the Gift Voucher holder must pay the difference between the voucher value and the applicable tour price.

Segway Tours WA may refuse to redeem a Gift Voucher where it reasonably suspects fraud until it is satisfied that the Gift Voucher is valid.

Segway Tours WA is not liable for lost or stolen Gift Vouchers. Please contact Segway Tours WA promptly if a Gift Voucher has been lost or stolen.

These Gift Voucher terms are governed by the laws of Western Australia. Gift Voucher holders and tour participants are also subject to the applicable Segway Tours WA Terms & Conditions published at www.segwaytourswa.com.au
